10 RESOLUTION REGARDING
20 A BAN ON FLAG-BURNING
30 WHEREAS: The US House of Representatives has passed an amendment on
40 flag-burning; and,
50 WHEREAS: Flag-burning is an offensive, yet rare form of expression; and,
60 WHEREAS: Article I of the US Constitution states: "Congress shall make no
70 law respecting an establishment of religion, or prohibiting the
80 free exercise thereof; or abridging the freedom of speech,
90 or of the press; or the right of the people peaceably to assemble,
100 and to petition the Government for a redress of grievances; and,
110 WHEREAS: According to U.S. Code (before the Supreme Court case of
120 Texas v. Johnson) ''The term 'flag of the United States' as used in
130 this section, shall include any flag, standard colors, ensign, or any
140 picture or representation of either, or of any part or parts of either,
150 made of any substance or represented on any substance, of any size
160 evidently purporting to be either of said flag, standard, color, or
170 ensign of the United States of America, or a picture or a
180 representation of either, upon which shall be shown the colors, the
190 stars and the stripes, in any number of either thereof, or of any part
200 or parts of either, by which the average person seeing the same
210 without deliberation may believe the same to represent the flag,
220 standards, colors, or ensign of the United States of America;" and,
230 WHEREAS: The amendment failed to get a majority vote in the US Senate,
240 THEREFORE BE IT RESOLVED: That the Maryland Student Legislature
250 opposes such anti-flag-burning legislation; and,
260 BE IT FURTHER RESOLVED: That the Maryland Student Legislature commends
270 the thirty-seven Senators who voted against the flag-burning
280 amendment.
