10 AN ACT CONCERNING

110 SECTION 1. BE IT ENACTED BY THE MARYALND STUDENT
120 LEGISLATURE: that the laws of Maryland read as follows

150 (a) (1) Subject to the authority of the Secretary and, where applicable, the Maryland
160 Transportation Authority, the Administration has jurisdiction:
170 (i) Consistent with the provisions of Division II of the State Finance and
180 Procurement Article, for planning, developing, constructing, acquiring,
190 financing, and operating the transit facilities authorized by this title; and
200 (ii) Over the services performed by and the rentals, rates, fees, fares, and other
210 charges imposed for the services performed by transit facilities owned or
220 controlled by the Administration.
230 (2) (i) For fiscal years 1988 through 1992 2001 and each fiscal year thereafter, the
240 Administration shall recover from fares and other operating revenues at least 50
250 40 percent of the total operating costs for the mass transit bus and rail services
260 under its jurisdiction. It is the intent of the General Assembly that the provisions
270 of this paragraph shall apply on a system-wide basis and not on an individual
280 transit line basis. However, given the anticipated efficiency of light rail
290 technology, the Department is encouraged, after 2 years of light rail operation,
300 to recover from fares and other operating revenues at least 60 percent of the total
310 operating costs for light rail services. THE ADMINISTRATION SHALL
320 RECOVER FROM FARES AND OTHER OPERATING REVENUES AT
330 LEAST 50 PERCENT OF THE TOTAL OPERATING COSTS FOR THE
340 LIGHT RAIL SERVICES UNDER ITS JURISDICTION.
350 (ii) The Administration shall obtain the fare recovery ratio through the
360 establishment of reasonable fares in the Baltimore region and the
370 implementation of cost containment measures as deemed necessary to meet the
380 standard required under this paragraph.
390 (b) The determinations of the Secretary, Administration, or Maryland Transportation
400 Authority as to the type of service performed or the rentals, rates, fees, fares, and other
410 charges imposed are not subject to judicial review or to the processes of any court.
420 (c) Notwithstanding any other provision of this title or the Public Utility Companies Article,
430 the Public Service Commission does not have any jurisdiction over transit facilities
440 owned or controlled by the Administration or over any contractor operating these
450 facilities.
460 (d) Except as provided in this title, the Administration does not have any jurisdiction over
470 transportation in the District by private carriers.
480 SECTION 2. AND BE IT FURTHER ENACTED, that this act shall take effect
