10 AN ACT concerning

20 		Discrimination Based Upon Sexual Orientation 

30	FOR the purpose of making it unlawful for any employer to discriminate against 
40	employees or prospective employees because of their sexual orientation.

50	BY repealing and reenacting,

90	SECTION 1. BE IT ENACTED BY THE MARYLAND STUDENT 
100	LEGISLATURE, That the laws of Maryland read as follows:

110				Article 49B

120	¤ 16 (a) and (b)

130	(a)  It shall be an unlawful employment practice for an employer:

140		(1)	To fail or refuse to hire or to discharge any individual, or otherwise 
150			to discriminate against any individual with respect to his 
160 			compensation, terms, conditions, or privileges of employment, 
170			because of such individualās race, color, religion, sex, age, national 
180			origin, marital status, SEXUAL ORIENTATION, or physical or 
190			mental handicap unrelated in nature and extent so as to reasonably 
200			preclude the performance of the employment; or 

210		(2)	To limit, segregate, or classify his employees or applicants for 
220			employment in any way which would deprive or tend to deprive 
230			any individual of employment opportunities or otherwise adversely 
240			affect his status as an employee, because of the individualās race, 
250			color, religion, sex, age, national origin, marital status, SEXUAL 
260			ORIENTATION, or physical or mental handicap unrelated in 
270			nature and extent so as to reasonably preclude the performance of 
280			the employment;

290	(b)  It shall be an unlawful employment practice for an employment agency to fail 
300	or refuse to refer for employment, or otherwise to discriminate against, any 
310	individual because of his race, color, religion, sex, age, national origin, marital 
320	status, SEXUAL ORIENTATION, or physical or mental handicap unrelated in 
330	nature and extent so as to reasonably preclude the performance of the 
340	employment;

350 	SECTION 2. AND BE IT FURTHER ENACTED, That this Act take effect 
360	July 1, 1999.
